Ich möchte doch etwas klarstellen:
1) @Andrej12683 #173867: ...es kommt darauf an, wo Du die Aktien gekauft hast. Bei einer Bank? OK, dann hast Du sicherlich keine FTDs (Failed To Delivery) im Depot. Bei einem Broker: mit deutscher Lizenz: die haften, wenn sie nicht liefern; bei einem Ami-Broker: da kannst Du klagen (wenn Du das nötige Kleingeld hast!)
2) @all ...das am 12.12.2011 eingereichte DS samt POR7 kann jeder vergessen. Habe mir jetzt beides durchgelesen! Ich kann mir nicht vorstellen, dass dieser Schmöker auch nur annähernd die Chance einer Anhörung hätte. BR rudert darin kräftig zurück, doch gleichzeitig versucht er in einer beschwörenden Form sondersgleichen viele Hindernisse einzubauen.
Das gipfelt darin, dass er die Releases als wesentlichen Teil des GSA in Verbindung mit dem POR7 sieht und dabei feststellt, dass alles im Einklang mit den Bedingungen des GSA und den in der Mediation ausgehandelten Kompromissen stünde:
"As set forth in more detail in Section VI.O hereof, the Seventh Amended Plan provides for certain releases of Claims by the Debtors, Creditors’ Committee, Equity Committee and by holders of Claims and Equity Interests. The releases in the Seventh Amended Plan are (i) essential to the success of the Debtors’ reorganization, (ii) based on a critical financial contribution of the Released Parties, (iii) necessary to make the Seventh Amended Plan feasible, and (iv) fair to Creditors. The releases are integral to obtaining the value provided pursuant to (i) the Global Settlement Agreement and (ii) the compromise and settlement reached during the Mediation, both of which are deliverable pursuant to the Seventh Amended Plan. Accordingly the releases constitute an essential component of the compromises reached among the parties to the Global Settlement Agreement and the Mediation, and an essential component of the Seventh Amended Plan. As set forth in Section VI.O.5.b hereof, except with respect to Classes 1, 4, and 7, any holder of a Claim or Equity Interest that elects to opt out of, or fails to elect to opt in to, as the case may be, the releases set forth in the Non-Debtor Release Provision (Section 41.6 of the Seventh Amended Plan) will not receive a distribution."
...und stellt dabei aber auch klar zuzustimmen ...ansonsten is' nix mit der Kohle.
...das gipfelt darüberhinaus in der selbstüberschätzenden Feststellung:
"THIS DISCLOSURE STATEMENT IS NOT INTENDED TO REPLACE A CAREFUL AND DETAILED REVIEW AND ANALYSIS OF THE SEVENTH AMENDED PLAN BY EACH HOLDER OF A CLAIM OR EQUITY INTEREST. THE DISCLOSURE STATEMENT IS INTENDED TO AID AND SUPPLEMENT THAT REVIEW. THE DESCRIPTION OF THE SEVENTH AMENDED PLAN IS A SUMMARY ONLY, WHICH IS QUALIFIED IN ITS ENTIRETY BY REFERENCE TO THE FULL TEXT OF THE SEVENTH AMENDED PLAN, AND IF ANY INCONSISTENCY EXISTS BETWEEN THE TERMS AND PROVISIONS OF THE SEVENTH AMENDED PLAN AND THIS DISCLOSURE STATEMENT, THE TERMS AND PROVISIONS OF THE SEVENTH AMENDED PLAN ARE CONTROLLING. ...kurz zu deutsch: ...es ist durchaus möglich, dass zwischen dem DS und dem POR7 einige Inkonsistenzen bestehen (unter uns gesagt: es bestehen sehr viele; und zwar wesentliche Unterschiede). Er "warnt" dabei ausdrücklich, dass nur das im POR7 gesagte seine Gültigkeit hat.
...aber das DS legt er zur Genehmigung durch JMW vor.
In der Runde der hier postenden Großmäuler gab's mal einen Idiotenberater.
...irgendwie dürfte dieser mit BR sowieso schon (oder noch immer) in Kontakt stehen. Dabei fällt mir spontan ein: ...man sollte die Anderen nicht für dümmer halten, als man selbst ist!
Nachdem die Ergebnisse der Mediation erst am Do 22.12.2011 vorliegen, versuchte BR nochmals einen Schuss vor den Bug abzugeben und hat nur einen Rohrkrepierer produziert (was sich sofort wieder im PPS niederschlug).
Bin jetzt wirklich gespannt, wie das EC am Do darauf reagiert. Aber eines ist sicherlich gewiss. Das "Juhu" von Seiten des EC bezog sich sicherlich nicht auf den von BR am 12.12. abgelieferten Schmarrn.
Sollte sich vor Weihnachten nichts von außergewöhnlicher Bedeutung ergeben, werde ich wieder mal eine Objection an das Konkursgericht senden.
