It’s a $4 billion issue. If we’re right, there’s $4 billion less in the estate and I don’t think the plan goes forward". Indeed not. This will potentially affect the bankruptcy hearing in its entirety and has the potential to, in essence, eliminate the need for any future hearings." Quelle: http://Quelle:">www.buzzle.com/articles/...r2010.html">http://Quelle: www.buzzle.com/articles/...utual-trial-date-set-for-november2010.html"
Here's an excerpt of the soon to be released objection:
"The government appointed Examiner did not investigate any crucial factor that should establish how
J.P. Morgan and Chase, the Federal Deposit Insurance Corporation, the Security and Exchange
Commission and the Rating Agencies could orchestrate a failure of the highly solvent Washington
Mutual-which had formal agreements with investors to add even more private capital upon approval
by government regulators-for an unconstitutional usurpation of the hard-earned savings of families
who had rationally invested in the Washington Mutual securities.
The case is not only about the unconstitutional usurpation of hard earned private property, savings
invested in Washington Mutual securities. It is also about a decimation of trust in American banking,
financial system and governance that has imploded the capital markets and forced the Federal Reserve
to print money for survival of the national economy. The Washington Mutual case is thus crucial for
financial wherewithal of every American. The government appointed Examiner obviously ignored
such profound issues by not investigating the crucial factors, as suggested in my earlier objection (the
time needed for such investigation would not be more than a few days):
1. Did J.P. Morgan and Chase and its affiliates engage in massive short sales of the financial
securities issued by Washington Mutual? The Examiner could simply investigate the market
clearing house records on trades and transfers of Washington Mutual financial securities to
establish the truth. But the Examiner did not make this investigation.
2. Why did the SEC not include Washington Mutual in the no-short sale list..."

WILMINGTON, Del. (TheStreet) -- Washington Mutual (WAMU.PK) has extended the deadline for creditors to vote on its bankruptcy plan as the failed thrift battles with a group of securities holders who disagree with its reorganization plan.
Creditors now have until next Thursday to cast their votes, three days later than the original deadline.
A group of investors led by Black Horse Capital are fighting to prevent $4 billion worth of trust preferred securities from being transferred to JPMorgan Chase (JPM_). The group holds $1 billion worth of those TruPS. They filed a lawsuit earlier this year, claiming federal regulators didn't have a right to exchange the TruPS into preferred stock when seizing WaMu in September 2008.
The investors have scheduled a deposition of William Kosturos, WaMu's chief restructuring officer, for Tuesday, to question him about the TruPS exchange, among other things.
Under the current restructuring plan, about $7 billion would go to bondholders, but shareholders would be wiped out. Most of WaMu's existing assets would be liquidated, except for a reinsurance company that would exit bankruptcy intact.
The long-running litigation battle over Washington Mutual's failure has had several twists and turns. Shareholders were delivered a devastating blow earlier this month by an independent examiner. He suggested that their lawsuits weren't worth pursuing because they're unlikely to squeeze any value beyond what's being distributed to creditors.
Since that time WaMu shares, which trade on the pink sheets, have plunged from about 17 cents to as low as 4 cents. On Thursday, the stock was down 4.2% at 5.5 cents.
The plan is subject to a court confirmation hearing scheduled to begin on Dec. 1.
