The judge ruled today on an application by SNH to delay preliminary liquidation proceedings until an appeal against the in limine decision on jurisdiction is resolved. By denying that application she has opened the door for an urgent appeal at the SCA by way of s18(4)(iii). Whether this was her intent or she believes in her decision is irrelevant for the purposes of the appeal to the SCA. I believe that will be SNH's next action.
