Well, at least the worst is over.
Despite Seth Ard’s painfully inartful cross of the Blackstone representative, we managed to end yesterday with the NOLs still in a state of positive flux, their non-monetized value floating somewhere between $2.5B and $10B and $24B. Though the Blackstone representative did an excellent job at attempting to sweep the ramifications of IN RE: CORAM off the table, he failed to do so. In this regard, I took heart at the fact that this was the second time in which Blackstone has proferred these same numbers. Walrath clearly didn’t believe their accuracy back in December; and there was no additional information rendered yesterday that might have caused her to change her thinking in that regard. Without more, we might have had a problem, however, Anderson (despite a less than stirring appearance) did indeed manage to lend significant credence to the assertion that the NOLs are greatly undervalued. This, coupled with Art Steinberg’s masterful display of legal prowess, effectively checked the strength of Reinhold’s testimony on the subject. Bottom line then: we took their best shots and are still standing. Bloodied somewhat, but still standing and scrapping for the fight to continue.
