Heute kam ja auch Richter Bozaleks Aussage zur Sprache. Ich habe den korrekten Wortlaut gefunden:
"[138] The applicants sought an interdict restraining SIHPL from making any payment pursuant to the SIHPL Guarantee, the SIHPL CPU or the compromise proposed by SIHPL in terms of sec 155 of the Companies Act and from providing any security in respect thereof. In terms of this judgment the SIHPL Guarantee stands and clearly no interdictory relief in relation to it can be granted. As far as the balance of the interdictory relief is concerned, the applicants made out no case that any payments pursuant to the SIHPL CPU were imminent. Insofar as any payments made based on the CPU might conceivably follow upon the acceptance of the sec 155 proposal, not only might that proposal be revisited following this judgment, but the sec 155 process has some way to go before it can be sanctioned by a Court. Before that stage is reached the applicants will have adequate opportunity to voice their opposition to any such proposal or interdict any prior payments which they regard as unlawful. Accordingly, the applicants have failed to make out any case for interdictory relief. "

1. Mûsste man das auch mit Trevos 2R Billion machen, was, wenn ich nicht falsch liege, nochmal rund 60 Mio Euro sind.
2. Wer würde das nun konkret zahlen?
3. Bad Faith. Eine Entschädigung, die höher ist als das Angebot an die Gruppierungen, die dem s155 und dem SoP zugestimmt haben, sehe ich als Verhandlung in Bad Faith an.
Dann würden evtl. einige der Gruppen, die zugestimmt haben, das s155 blockieren. Was würde Hamilton davon abhalten Einspruch einzulegen mit der Begründung, dass Steinhoff über Dritte einigen Gruppen mehr als den Betrag im Settlement zukommen lässt? Ich könnte mir auch vorstellen, dass es dem Richter des s155 Prozesses nicht gefallen würde, wenn Trevo und Mostert besser gestellt wären. Eine ähnliche Debatte hatten wir ja mit Hamilton schon einmal.
Das obige ist lediglich meine Meinung und wer an eine Einigung glaubt kann das tun. Ich schließe diese auch nicht komplett aus. Ich sehe die Chance nur als seh sehr gering an.
Trevos Claims von 2 Mrd Rand: "[2] The applicants in the present matter are two such claimants. The first applicant, Trevo Capital Ltd (hereinafter ‘Trevo’), instituted action against the first respondent (Steinhoff International Holdings (Pty) Ltd) (hereinafter ‘SIHPL’), claiming in excess of R2bil, being a loss allegedly suffered as a result of SIHPL’s alleged intentional, alternatively, negligent misstatements in its 2015 annual financial statements. The action is at an advanced stage but has not yet been certified as ‘trial ready’. Trevo’s case is that, but for such statements, it would not have purchased shares by means of a forward sale which it concluded on or about in October 2015 with a related company."
