Man kann es nicht oft genug sagen, dass eine Verhandlung/außergerichtliche Einigung äußerst unwahrscheinlich ist.
Im s155 sind mehrere Parteien vertreten. So auch etwa Trevo, die man jedoch extra vorher aus dem Settlement ausgesondert hat. Hier die DGAP mit den Intervenierern:
"The Court has in the recent days received intervention and opposing applications from the following:
(1) a party who under the Proposal is a Non-Qualifying Claimant and that will continue to be disputed following the implementation of the Settlement Effective Date, being: Trevo Capital Limited, a Mauritian entity associated with the former CEO of Pepkor Holdings Limited, Mr Erasmus; with the support of six individuals, Messrs Morris, Potter, Berry, Botha, Malan and Steyn (who are also all Non-Qualifying Claimants); and
(2) parties purporting to be Market Purchase Claimants under the Proposal, being: the trustees of Sport City Trust and AJVH Holdings (Pty) Limited, both of which are associated with the former owners of Tekkie Town, and an individual, Mr Lamprecht.
In addition, an intervention application in support of SIHPL's sanction application has been received from Deloitte SA."
Steinhoff schreibt weiter, dass sie sich gegen die Einsprüche wehren wollen!! Steinhoff selber sieht somit keinen Grund für eine Verhandlung.
"SIHPL will oppose certain of the interventions and all of the opposing applications as it continues to work towards implementing the Proposal that has achieved the overwhelming support of so many claimants and so that those claimants can receive the settlement consideration as soon as possible under the terms of the Proposal."

Laut Mostert hat keiner mit ihm bisher verhandelt und während der Liquidationsanhörung hat Steinhoff den Settlementbetrag plus Gerichtskosten angeboten. Mostert hat aber auch keine Alternative verlauten lassen, die eine Verhandlung zulassen würde.
O-Ton: Wir wollen unser Geschäft zurück.
Auch WICHTIG: Da Mostert und Co das s155 blockieren, kann Steinhoff ihm NICHT mehr anbieten als das Settlement zulässt ohne das s155 nochmal neu aufzurollen. Dazu gehören auch Dritte, wie Doilette, die nicht einfach einspringen können, und da Doilette selber gegen Mosterts Einspruch vorgeht, sehe ich von dieser Seite keine Bereitschaft mehr Geld springen zu lassen.
Das heisst, dass sämtliche Einsprechende ihre Anträge/Einsprüche zurückziehen müssten und dann nach nem erfolgreichen s155 darauf hoffen, dass Steinhoff ihnen mehr bietet als im Settlement.
Ich sehe es wie folgt: Laut der IR Mitteilung fand das Case Management Hearing letzte Woche statt ohne neue Erkenntnisse und der Prozess des Case Managements ist durch. Jetzt wartet man lediglich auf nen neuen Termin fürs s155 Sanctioning Hearing, was mich positiv stimmt, da es den Anschein hat, dass es in einem Tag gegessen ist, ohne irgentwelchen Interferenzen mit der Liquidationsklage.
IR Mitteilung: "Having said that we do appreciate the interest in the outstanding processes regarding the Sanction Application. As stated previously a meeting was held with the case management Judge in South Africa last week. At this stage no new date has been scheduled by the court for the hearing."
