DIRECTIONS BY THE COURT CONCERNING THE HEARING ON 19 MAY 2021 REGARDING THE APPLICATION BY THE ADMINISTRATORS FOR THE APPOINTMENT OF A COMMITTEE OF REPRESENTATION & MEASURES REGARDING THE LIST OF CLAIMS
At the request of the administrators, the Amsterdam District Court has determined some (operational) directions concerning the hearing of 19 May 2021 at 10.30 CET. Said directions are set out in an emailfrom the Court, which at the request of the court is cited in its entirety below. An informal English translation of the email from the Court is also provided below.
*** Dear Mr Heems, Following your email of 5 May 2021 regarding the suspension of payment of Steinhoff International Holdings NV and after taking notice of the letters/emails/messages of Messrs. Schreurs and Van den Berg, I hereby notify you – on behalf of the court – as follows.
The court determines that on Wednesday 12 May 2021 on 15.00 [CET] at the latest:
a. statements of responses must have been filed;
b. parties that wish to attend the hearing and parties that wish to explain their position during the hearing, must have expressed its desire to do so to the court;
c. parties that have not yet been recognized as creditor by the administrators, must summarily prove that they are in fact a creditor.
Thereupon, the court will notify the administrators as soon as possible who will be effectively admitted to attend the hearing, taking into account the COVID-19 measures.
Interested parties that wish to attend the hearing in digital form, are requested to express their intention to do so on Friday 14 May 2021 on 15.00 [CET] at the latest, through the following email address: insolventies.amsterdam@rechtspraak.nl.
